MATTRESS WARRANTY STATEMENT

Limited Warranty

Clinton Bedding Manufacturing, Inc., d/b/a Clinton Bedding Company (hereinafter "Clinton Bedding Company") warrants its products to be free from defects in material and workmanship as described in this Limited Warranty (hereinafter "Warranty"). All materials and labor are covered for the full non-prorated Warranty to the original buyer only.

Length of Warranty

The Warranty starts on the date of purchase. The length of Warranty is determined by the mattress set purchased as stated in the product specification. Repair or replacement of the mattress or foundation neither renews, nor extends the length of the warranty.

The length of the Warranty is not an indication of how long the mattress set should last but is only the length of time a defective part will be replaced as covered under these terms. The life of the mattress set is mostly determined by the care and use it receives over time.


If a problem occurs...

In the unlikely event that a problem with a Clinton Bedding product occurs due to a defect in workmanship or material covered under Warranty, contact Clinton Bedding Company in a writing sent by certified mail to report the specific defect. Clinton Bedding Company may be notified of any claimed defect at Clinton Bedding Company, 255 Hiway Drive, Clinton, Tennessee, 37716.

If a problem occurs during the Warranty period and provided Clinton Bedding Company is properly notified and confirms a defect exists, your mattress and/or foundation will be repaired or replaced at Clinton Bedding Company's option within a commercially reasonable period of time, without charge to you except for transportation cost. Please note the defective mattress and/or foundation must be returned to Clinton Bedding Company's factory for inspection to determine the proper remedy, if any, under Warranty. All shipping costs to and from Clinton Bedding Company are the sole responsibility of the original buyer, regardless whether a defect is confirmed by Clinton Bedding Company or not.

Replacement or repair of your mattress and/or foundation is the only remedy under Warranty, except that if identical materials are not available at the time of product service, Clinton Bedding Company will replace/repair the defective materials with materials of equal or higher quality. In order for your Warranty to be valid: (1) You must be the original purchaser; (2) You must have proof of purchase from an authorized Clinton Bedding Company store; and (3) Your proof of purchase must indicate the purchase date, purchase price and place of purchase.

Other Limitations

By purchasing a product from Clinton Bedding Company, the purchaser expressly agrees the above Warranty is the sole and exclusive remedy available at law or in equity, and the purchaser waives any and all implied warranties, including any implied warranty of merchantability or fitness for a particular purpose, otherwise available at law or in equity. Notwithstanding the above, should a court of competent jurisdiction determine some other warranty may apply, the length of any other warranty shall not exceed in duration the term of the Warranty which begins on the date of purchase by the consumer and which is otherwise described above. The service terms stated in this Warranty shall be the purchaser's sole and exclusive remedy in the unlikely event of product failure during the Warranty period. By purchasing a product from Clinton Bedding Company, the purchaser agrees Clinton Bedding Company shall not be liable for incidental or consequential damages arising out of the use or inability to use any product purchased, or for the breach of this or any other express or implied warranty.

Clinton Bedding Company does not warrant any particular product is suitable for any particular person's medical condition, nor does Clinton Bedding Company warrant any particular product will subjectively appeal to the particular desires or wishes of a specific purchaser. Clinton Bedding Company makes no warranty beyond what is contained in this writing.

Some states do not allow limitations on how long an implied warranty may last, so this limitation may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state. By purchasing a product from Clinton Bedding Company, the purchaser agrees that the Courts of Anderson County, Tennessee, have the exclusive jurisdiction to determine the rights and liabilities of any claims made against Clinton Bedding Company, whether under theory of warranty, contact or otherwise. Clinton Bedding Company does not authorize any person to create for it any other obligation or liability in connection with this Warranty.
